For all VerThe following general terms and conditions apply to the delivery of seeds.

 
duration of the breeding season

The breeding season begins on February 1st and ends on August 1st of each year.

The seed order must contain the following information:
•     Desired stallion
•    Mare owner's full name and address and telephone numbers
•    Exact shipping address if different from that of the mare owner
•    Mare details (name/life number/copy of pedigree/age)

The delivered semen may only and exclusively be used for the specified mare!
•    Membership number of the breeding association to which the coverage by the DLZ should be reported
•    Veterinarian, with full address

 

Due to the change in the performance test regulations for stallions, we expressly point out that our stallions are used for breeding before the performance test has been completed at the breeder's risk. Of course, the DLZ will do its best to provide the required proof of performance, but cannot guarantee it.

Stud fee for fresh semendeliveries

The EU insemination station Lodbergen practices a breeder-friendly stud fee splitting, ie instead of the due date of theStud fee in full upon delivery of the semen and possible credit options in the event of non-pregnancy da  the following two-part system applies.
 

1.  The first part of the stud fee, the insemination fee, when ordering fresh semen from each of our stallions, applies for the entire duration of the stud season and is owed by the breeder in any case. It covers the cost of sperm collection and the processing of the fresh semen, as well as a proportion of the marketing and administrative costs. There is no entitlement to credits or discounts on the insemination fee. The insemination fee is due with the first delivery of semen. Not included in the insemination fee are the costs for the EU certificate, sperm shipping and veterinary costs as well as pension costs.
 

2.  The second part of the stud fee, the pregnancy fee, is only payable if the mare is assumed to be pregnant on October 1st. of the year in which the semen was delivered. The pregnancy on the 60th day after the last insemination is relevant.

 

Proof of non-pregnancy must be submitted by the breeder with a written certificate from the attending veterinarian to Dressurpferde Leistungszentrum Lodbergen GmbH, Zum Jägereck 2, 49624 Löningen, fax 0049-5432-595946-99, emailinfo@dressurleistungszentrum.de, to be provided without being asked by September 30 at the latest (time of receipt of the proof).
 

If there is no veterinary proof of non-pregnancy no later than 60 days after the last insemination, the pregnancy fee is automatically due. This also applies if non-pregnancy is proven for a later date.
 

3.  In the case of embryo transfer, the full stud fee is due for each grown embryo.If an embryo transfer is planned, we must be informed in advance and the flushing protocol sent immediately.
 

4.  In principle, there is no entitlement to several portions of seeds per steed, but this will be done if possible. Orders are shipped in the order in which they are received.
 

5.  Shipping of seeds abroad is only possible against payment in advance.

For mares reported as not in foal, neither a covering certificate nor a registration of the mare will be issued

VAT

In accordance with the reform of the EU sales tax law and the OSS (One-Stop-Shop) reporting procedure that has been in effect since July 1, 2021, all stud fees and transport costs are net prices and therefore plus the sales tax rate applicable at the place of delivery. In Germany, this is currently 7 percent.

 
TG insemination fee

For sold frozen semen (TG), the TG insemination fee is due for each individual insemination dose of the respective stallion. Stud fee splitting does not apply.

Not included in the TG insemination fee are the costs for shipping the TG semen and veterinary certificate. These costs will be invoiced separately to the customer (return transport is borne and organized by the customer himself).
 

Frozen semen must be ordered in good time so that the order can be processed, the frozen insemination fee invoiced and payment made to our account according to standard business processes prior to delivery.
 

The customer must provide a container for shipping, which must arrive at the DLZ in good time. The dispatch is carried out by a courier service and is invoiced separately at the expense of the client.
 

Please inquire about the special conditions in our office. Frozen semen may only be used in artificial insemination. The semen may only be used for eg embryo transfer or ICSI with the prior written consent of the DLZ. For animal breeding reasons, frozen semen is only sold to recognized insemination stations, semen depots and veterinary clinics. Passing on frozen semen to third parties and splitting portions is prohibited. Only one cover slip is issued for each portion sold. Violators will be prosecuted.
 

The TG insemination fee is due in any case, there is no entitlement to a credit in the event of non-pregnancy. For repeat orders for the same mare, a discount of 100 euros is granted on the respective TG insemination fee.
 

If a previously unregistered mare is covered at the end of the season, the breeder must pay at least double the amount of the full stud fee (200%) as a contractual penalty, regardless of fault. This regulation also applies to the embryo transfer procedure. The DLZ is also entitled to assert further claims for damages.

 
General

If, after the first delivery of fresh semen, a stallion is not available at short notice during the breeding season for special reasons (tournament use, illness, etc.), frozen semen can be used in individual cases, if possible, or another stallion from the station can be used. There is no entitlement to this, see the relevant paragraphs on the stud fee for the delivery of fresh semen. There is no entitlement to reimbursement of the insemination fee. However, it will be credited in full to the total stud fee of the newly used stallion.

If the breeder changes stallions for any reason, no fee will be charged for this. The amount of the pregnancy fee always refers to the last stallion used.

We cooperate with the station of Dr. Ute Vaske in Lastrup. The mares are housed there in good boxes with the possibility of grazing. The costs for the accommodation of the mares and veterinary care are covered by Dr. Ute Vaske billed directly to the breeder. The subordination takes place at the risk of the owner. The DLZ assumes no liability in connection with the accommodation.

 
Health care and deck hygiene

The owner of the mare or horse hereby agrees that a specialist veterinarian (station veterinarian) may be present at his or her premises if necessary loads is added if the stallion owner justifiably considers this to be appropriate. These costs are billed separately to the horse owner by the veterinarian. If he does not consider the appointment of the veterinarian to be expedient, he is responsible for proving this.

For free mares, with the exception of maiden mares, the owner must provide veterinary swab samples that must not be older than three weeks.

 
Liability

The DLZ is only liable for damage caused intentionally or through gross negligence by its representatives or vicarious agents. This liability limit includes all damage that may occur during the mares' hiring and the mares' feeding to the stallions.

The DLZ is not liable for damage caused by third parties.

To cover the risk from animal owner and animal caretaker liability (833, 834 BGB), the owner must take out liability insurance of an appropriate and customary amount and provide evidence of this on request.

 
Fulfillment and jurisdiction

Place of performance and place of jurisdiction is Lodbergen, also for current or future claims from this business relationship.

 
Applicable Law

German law applies to all contracts.
